COHIBA’ s rights in the U.E.
Unexpectedly the Community Court of Luxemburgo has rejected the sue filed by Corporación Habanos, S.A. against the application for registration of the Community trademark Kiowa & Device No. 3.963.931 on behalf of Tabacos de Centroamérica S.L.
Corporación Habanos S.A., the worldwide leader of Premium cigars in the market and the owner of the Cuban well known and prestigious trademark COHIBA, maintain the criteria of similarity and risk of confusion by the public consumers between both brands. Likewise, is claiming that Tabacos de Centroamérica, S.L. is taking advantages of the reputation and distinctive character of its COHIBA trademark and its Indian Head traditional device.
Corporación Habanos, S.A. shall keep claiming its genuine and demonstrated rights before any instance and any infringer in defense of the most emblematical Cuban cigar brand: COHIBA.
